WEST POINT — The Clay County woman found guilty of negligence and fined $50 for running over Starkville cyclist Jan Morgan has filed an appeal.
Robbie Norton of Cedar Bluff will have her case heard in Clay County Circuit Court on April 2, according to the circuit clerk’s office.
Morgan originally filed simple assault with a deadly weapon charges, though Justice Court Judge Joe Taggart opted for a guilty verdict of negligent driving in November.
Morgan was struck by Norton while she and a friend biked along Highway 50 in western Clay County last May.
According to state law, Morgan had to prove Norton purposely or recklessly caused bodily harm with a weapon or anything that could cause death.
Witnesses said Norton ran over Morgan’s head a second time while trying to move her vehicle to the side of the road.
Morgan was in a coma for close to a month and spent rehabilitation time at the Shepherd Center in Atlanta and the Quest Center in Jackson.
Morgan has since been fully discharged from outpatient therapy and has been cleared by her therapist to drive a car.
Prosecutors said at the time Norton broke no laws and that it was an accident.

There is a $108 fee to file an appeal in circuit court.
