Holliman appeal hearing rescheduled

An appeal hearing for convicted murderer Brian Holliman was continued Tuesday morning due to a clerical error. 


Holliman was scheduled to appear in Lowndes County Circuit Court on a motion to appeal hearing. Holliman is appealing his August conviction of the 2008 murder of his wife Laura Lee Godfrey Holliman in Caledonia. 


Holliman is currently incarcerated in a facility in Walnut Grove in Leake County. He was supposed to be transported from Walnut Grove to the Lowndes County Adult Detention Center by the Mississippi Department of Corrections for the hearing. However, MDOC claims they never received a transport request from circuit court. Officials at circuit court claim they sent the request. 


Addressing the court, presiding judge Lee Howard said the MDOC mix-up was not the first instance where a prisoner had not been transported. 


"It's not the first time and it won't be the last," Howard said. 


A defendant must be present at a motion to appeal hearing. Holliman's appeal hearing was rescheduled for Friday morning at 9 a.m.
