JACKSON -- The state Court of Appeals has upheld the dismissal of a post-conviction petition of a Columbus nurse convicted of abusing a vulnerable person in her care.
Sherrill Culpepper had pleaded guilty in 2012 in Lowndes County Circuit Court and was sentenced to 10 years in prison. A Lowndes County judge denied her post-conviction petition later that year.
Prosecutors say Culpepper was accused of putting a hot flat iron on the skin of a vulnerable person.
Court records show Culpepper sought a new trial on grounds her attorney didn't do a good job.
The Appeals Court ruled Tuesday that much of what Culpepper was arguing fell under legal strategy. The court says even there were some deficiencies in performance, Culpepper failed to show how her sentence would have been different.
